The Food Network “Next Food Network Star/You Tube Challenge” has begun — the search for the Next Food Network Star online! The Food Network has put out a challenge asking YouTube users to submit video entries to be considered for The Next Food Network Star. Want to be the next Bobby Flay or Giada de Laurentis? Just take a camera to the kitchen and show Food Network what you’ve got. Here’s more info on the Next Food Network Star/You Tube Challenge, with the official rules below:
The Food Network “Next Food Network Star/You Tube Challenge” Video Contest (the “Contest”) is open to all legal residents of the 48 contiguous United States and the District of Columbia, 21 years of age or older and a registered user of YouTube except employees, officers, directors, agents (and their immediate families [spouse, parent, child, sibling and their respective spouses] and household members [whether or not related]) of Scripps Networks, LLC (the “Sponsor”), Samsung Electronics America, Inc., and its respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, advertising and promotion agencies, Google Inc. of 1600 Ampitheater Parkway, Mountain View, CA 94043, and affiliated entities (collectively, with the Sponsor, “Contest Entities”). To become a Registered User of the YouTube Site, you must register for an account and agree to the YouTube Site’s “Terms of Use” set forth at www.youtube.com/t/terms (“Terms of Use”). There is no fee or charge to become a Registered User. Void where prohibited by law. Contest is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. By entering the Contest, entrants agree to accept and be bound by all terms of these Official Rules and Regulations (“Official Rules”).
HOW TO ENTER:
From 5:00 p.m. Eastern Time (“ET”) on June 8, 2010 through 9:00 a.m. ET on July 16, 2010 (the “Promotion Period”), Sponsor will conduct a national skill contest encouraging participants to demonstrate why they should have their own Food Network Show. To enter this Contest participants must visit www.youtube.com/foodnetwork, login to their YouTube Account or register for a YouTube Account and become a member, and follow the online instructions to upload a video depicting the following things: i) describing themselves, including stating only their first name, any video including the entrant’s last name will be void; ii) demonstrating how they cook; and iii) why they should have their own Food Network show. The entry form including video will be referred to collectively as the “Submission.” To be eligible: (i) each entry must be received no later than 9:00 a.m. ET on July 16, 2010 and (ii) all videos must be between 1 – 3 minutes in length and cannot exceed 2GB. All entries must be submitted in the name of an individual person and the prize can only be awarded to the person whose name is on the winning entry. All entries must be in English. Entrant warrants and represents: (a) he/she is the sole and exclusive author and owner of the Submission, including all rights therein, and that the video has not won any previous awards or competitions; (b) videos have not been professionally made or submitted by or through a television producer or other media industry professional; (c) entrant has the full and exclusive right, power and authority to submit the Submission and to grant the Contest Entities the rights the rights to use the Submission as set forth in the Official Rules.; (d) no part of the Submission, including but not limited to the worldwide copyright; (e) no rights in the Submission have been previously granted to any person, firm, corporation or other entity; or (f) that you have obtained permission from any person whose name or likeness is used in the Submission and that such person is 18 years of age or older, or, if any person whose name or likeness is used in the Contest Entry is under the age of 18, that you are the parent/legal guardian of said person. The video must not contain any music or show any clothing or items that reveal logos or brand names or the names or images of any person other than entrant. Sponsor reserves the right in their sole discretion to disqualify any Submission at any time in the event it is determined that the Submission is offensive, inappropriate, not in keeping with Sponsor’s images or if it is determined that the entrant has not otherwise complied with these Official Rules. If the Submission contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Submission, any and all releases and consents necessary to permit the use and exhibition of the Submission by Sponsor in the manner set forth in these Official Rules. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any participant at any time. Entries generated by script, macro or other automated means will be void. The Contest Entities are not responsible for misdirected, incomplete, lost, late, or inaccurate entries, nor for technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a person’s ability to participate in the Contest, whether human, mechanical, typographical, printing, electronic, network or otherwise, relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prize or in any Contest-related materials. Proof of submission is not considered proof of delivery or receipt. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond the Sponsor’s control, which corrupt the integrity, administration, security or proper operation of the Contest, Sponsor reserves the right, in their sole discretion, to modify, cancel or suspend the Contest. In the event of cancellation, Sponsor reserves the right to judge all eligible, non-suspect Submissions received prior to the event requiring such cancellation using the judging procedure outlined below. False or deceptive Submissions or acts will render the entrant ineligible. Each entrant hereby acknowledges and agrees that the relationship between entrant and Sponsor is not a confidential, fiduciary, or other special relationship, and that entrant’s decision to submit his/her Submission to Sponsor for purposes of the Contest does not place Sponsor in a position that is any different from the position held by members of the general public with regard to elements of entrant’s Submission. By entering this Contest, entrant acknowledges and agrees that Sponsor may receive many Submissions under this Contest and that such Submissions may be similar or identical in theme, idea, format or other respects to others submitted under the terms of this Contest and/or other contests staged and/or sponsored by Sponsor, and waive any and all claims entrant may have had, may have, and/or may have in the future, that any Submissions and/or other works accepted, reviewed and/or used by other entrants and/or Sponsor (or their designees) may be similar to entrant’s Submission. Entrant acknowledges and agrees that Sponsor has not, nor shall have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to entrant’s Submission. Limit: one (1) Submission per person.
HOW TO WIN/JUDGING:
Starting at 5:00 p.m. ET on July 17, 2010 through 5:00 p.m. ET on August 1, 2010 representatives from the Sponsor will review each of the eligible Submissions and rank them based on the below Judging Criteria. Up to fifteen (15) submissions with the highest scores will be the Finalists (the “Finalists”).
Starting at 5:00 p.m. ET on August 2, 2010 through 5:00 p.m. ET on August 16, 2010 (“Users Judging Period”), users can visit www.youtube.com/foodnetwork and vote for their favorite Submission from among the Finalists.
Users may use the below judging criteria as a guideline when casting their votes.
Users are allowed to vote once per Submission per day. At the end of the Users Judging Period, the Submission with the highest number of “thumbs up” votes will be considered the Grand Prize winner (the “Winner”). The decision of the judges will be final and binding in all matters. The Winner will be confirmed by U.S. mail, e-mail and/or telephone and must meet all eligibility requirements including the timely execution and return of all necessary releases and documents required by Sponsor. Winner will be announced on/about August 23, 2010.
Eligible Submissions will be judged on the following weighted basis (the “Judging Criteria”):
(i) Creativity/Originality – 10%
(ii) On-air Personality and Style – 40%
(iii) Knowledge and Presentation of food and cooking – 40%
(iv) Overall Video Performance – 10%
In the event of a tie, the entries involved will be re-judged by the Sponsor who will serve as the tiebreaker.
PRIZE:
One (1) Grand Prize Winner (“Winner”) will receive a trip for two (2) to New York City, NY consisting of the following: (i) roundtrip coach airfare to NYC, NY from the major airport closest to winner’s home address; (ii) first class hotel accommodations (1 room, double occupancy; room rate and tax only) for three (3) days/two (2) nights; (iii) round-trip sedan transportation from airport/hotel/airport; (iv) dinner for two (2) at a Food Network chef’s restaurant; and (v) a meeting with the Television Food Network executives. Approximate Retail Value (ARV) of this Prize Package is $3,880.
Total ARV of the one (1) prize to be given away: $3,880.
The specifics of all aforementioned elements of the Prize in the Contest shall be solely determined by Sponsor. All costs, taxes, fees, and expenses (including, but not limited to meals, beverages, incidentals, tips, or other personal expenses) associated with acceptance and use of any element of the Prize not specifically addressed above as being awarded are the sole responsibility of the Winner. Prize travel arrangements subject to availability, some restrictions may apply and may require connecting flights. Winner and travel companion must travel on the same itinerary (at the same time and to and from the same city). All travel is subject to availability. Once travel arrangements have been made and tickets have been purchased, travel may only be altered at the sole expense of the winner. No substitution or transfer of prizes permitted, except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute for any reason whatsoever a prize (or portion thereof) of comparable or greater value, at their sole discretion. Winner is responsible for the reporting and payment of all taxes (if any) associated with acceptance and use of a prize not specified herein.
GENERAL RULES AND REGULATIONS:
By entering this Contest, participants grant Contest Entities and their designees the right, unless prohibited by law, to use their names, cities and states of residences, voices, pictures and likenesses, without compensation, notification or approval, for the purpose of advertising and publicizing the goods and services of the Contest Entities and all matters related to the Contest, in any manner or medium, now or hereafter known, throughout the world in perpetuity. Winner will be required to execute an Affidavit of Eligibility, a Liability Release, a tax acknowledgment form and, except where prohibited by law, a Publicity Release, and return those items within three (3) days of issuance of notification. Travel companion of Winner must be 18 years of age or older or accompanied by a parent or legal guardian if a minor, and will be required to sign publicity and liability releases, and return same, properly executed, prior to issuance of travel documents. Noncompliance within this time period or failure of a potential Winner to respond to a notification attempt within three (3) days of such attempt may result in disqualification and, at Sponsor’s sole discretion, an alternate winner may be selected. If: (i) any prize or prize notification is returned as undeliverable, (ii) a potential Winner declines his or her prize, (iii) a potential Winner fails to comply with any of the Official Rules as outlined herein, such potential Winner will be disqualified and an alternate Winner will be selected by the Judges, based on the Judging Criteria, at the Sponsor’s sole discretion. With respect to each participant’s submission, entrants hereby irrevocably grant Sponsor the exclusive, perpetual, worldwide right to use the Submission and Submission materials, in whole or in part, alone or in combination with other material, or as a basis for new material, as Sponsor may determine in their sole discretion and for the purposes of advertising and promoting the Contest and/or the exhibitors thereof, and to use the Submission and/or Submission materials in connection with the Contest and related advertising and promotion or otherwise, but not as a direct endorsement for any product. Without limiting the generality of the foregoing, participants agree that the rights granted hereunder shall include, but not be limited to, the perpetual, worldwide right of Sponsor and their designees to use, edit, adapt, arrange, telecast, cablecast, rerun, record, publish, reproduce, license, print, distribute and/or otherwise exploit, in any language and in all media now known or hereafter devised, the Submission and/or Submission materials in whole or in part, without any further compensation to participant. Participants may be required to execute any documents necessary to perfect such rights to the Sponsor. The Contest Entities expressly disclaim any responsibility and entrants agree to indemnify and hold harmless the Contest Entities from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Contest (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of the prize awarded (including any travel or activity related thereto).
